Kontour Labs (trading as Kontour) (ABN 42 804 457 907) ("we," "us," or "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, and safeguard your information when you use the Anyways application, our websites (including kontour.io and anyways.kontour.io), and our authentication service, Kontour Identity (collectively, the "Services").

We adhere to the Australian Privacy Principles contained in the Privacy Act 1988 (Cth).

2. Information We Collect

A. Information You Provide

When you create an account via Kontour Identity, you may provide the following information. Some fields are optional:

  • Display Name: Used to identify you in the Services.
  • Email Address: Used for authentication, account management, and important service updates.
  • Phone Number (Optional): Used for multi-factor authentication if elected.
  • Demographic Information (Optional): You may choose to provide your birthdate, gender, timezone, and preferred language (currently supporting English). This information helps us personalise your experience.
  • Authentication Data: We utilize Authgear (a third-party authentication provider) to securely manage your login credentials. We do not store your raw passwords on our servers.
  • Support Enquiries: When you contact us via our website or support forms, we collect your name, email address, the content of your message, and any attachments you upload. We use this information solely to resolve your support request.

B. Information Collected Automatically

  • Device ID: We collect your unique Device ID to send voluntary disruption alerts and notifications.
  • Precise Location (Ephemeral): We access your precise location to provide real-time features, such as identifying nearby stops and improving search results. This data is transmitted to our servers to fulfill your request but is not stored or retained.
  • Cookies and Web Activity: When you visit our websites (such as kontour.io), we use cookies to analyze how you use the site and to distinguish between mobile and desktop users. You can control cookies through your browser settings, though some site features may not function properly without them.
  • Usage Trends (Aggregated): We use Google Analytics to understand usage trends across our App and Websites on a macro level (e.g., popular features, aggregate user retention, and website visitor sources).
  • Crash Data: We use Firebase Crashlytics to collect stack traces and crash reports. This helps us identify and fix bugs to improve App stability.
  • Advertising IDs: We use identifiers (such as the Android Advertising ID or Apple IDFA) to serve advertisements via Google AdMob.

C. Information We DO NOT Collect

  • Location History: We do not collect or store a history of your precise location or movements on our servers. While we process your current location ephemerally to provide specific features (as described in Section 2B), we do not track or log your journey over time.

3. How We Use Your Information

We use the collected data for the following purposes:

  • To provide and maintain the Services and their features.
  • To provide location-based services, such as returning nearby stops.
  • To manage your account and authentication via Kontour Identity.
  • To send you disruption alerts (only if you have opted in).
  • To display third-party advertisements via Google AdMob.
  • To analyze aggregated trends and fix technical issues (crashes) to improve user experience.

4. Overseas Disclosure of Data

To provide the Services’ functionality, we use third-party service providers (such as Authgear, Google, and Stripe) who may store or process your data outside of Australia.

  • By providing us with your personal information, you consent to the disclosure of your information to these overseas recipients.
  • While we take reasonable steps to ensure these providers protect your data, you acknowledge that they may not be subject to the Privacy Act 1988 (Cth).

5. Data Retention

We retain your personal information only as long as necessary:

  • Account Data (Name, Email, Demographics): Retained indefinitely until you request account deletion via Kontour Identity.
  • Device IDs: Retained for a minimum of 90 days. If the Anyways application is not opened for 90 days, this data may be deleted.
  • Analytics & Advertising Data: Retained for 14 months in accordance with our Google Analytics configuration.

6. Your Rights

A. Access and Correction

You have the right to request access to the personal information we hold about you and to ask for corrections if it is inaccurate. You can manage most of your data directly via the Kontour Identity portal. For other requests, please contact us.

B. Account Deletion

Account deletion is managed centrally via Kontour Identity. You can request the deletion of your account and associated data through the Kontour Identity portal. This will permanently remove your data from the Anyways App and other Kontour services.

C. Opt-Out

You may opt out of push notifications via your device settings.

7. Children's Privacy

The Services are intended for general audiences. We do not knowingly collect personal data from children under the age of 13 without parental consent. If you are a parent and believe your child has provided us with personal information, please contact us.

8. Changes to This Privacy Policy

We may update our Privacy Policy from time to time. We will notify you of any material changes via a prominent notice within the Anyways application (such as a pop-up), by email (if you are a registered user), or by posting the new Privacy Policy on this page. You are advised to review this Privacy Policy periodically for any changes.

9. Complaints

If you have a complaint about how we handle your personal information, please contact us using the details below. We will respond to your complaint within a reasonable timeframe (usually 30 days). If you are not satisfied with our response, you may contact the Office of the Australian Information Commissioner (OAIC).
