1. Acceptance of Terms
By downloading, accessing, or using the Anyways application, the Kontour Labs website (kontour.io), and related services (collectively, the "Services") provided by Kontour Labs (trading as Kontour) (ABN 42 804 457 907) ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use Anyways.
2. Service Description
The App provides real-time public transport tracking and related information. The Services are provided "as is" and "as available."
3. Data Accuracy & Liability
A. Third-Party Transport Data
The Anyways application displays transit data provided by third-party agencies. We acknowledge and attribute data from the following sources:
- Transport for NSW: Made with Transport for NSW Open Data.
- Public Transport Victoria (PTV): This application includes data sourced from Public Transport Victoria.
- Transperth: Data provided by the Public Transport Authority of Western Australia.
We do not guarantee the accuracy, completeness, or timeliness of this data. Kontour Labs is not liable for any missed trips, delays, or financial losses resulting from reliance on the data provided in the Anyways application.
B. Maps
Map data is provided by Mapbox. Your use of the maps is subject to Mapbox’s Terms of Use.
C. Website Content
The information provided on our website (kontour.io) is for general informational and marketing purposes only. While we strive for accuracy, we do not warrant that the marketing materials, blog posts, or feature descriptions on the website are error-free or perfectly current.
4. User Accounts (Kontour Identity)
- You may use the Services as a "Guest" or register for an account using Kontour Identity.
- Kontour Identity is our centralized identity service used to manage access across Kontour products.
- Authentication is managed securely via Authgear.
- You are responsible for maintaining the confidentiality of your login methods (e.g., email access, passkeys).
- You agree not to use the Services for any illegal purpose.
5. Prohibitions
You must not:
- Reverse engineer, decompile, or disassemble the Services.
- Scrape, crawl, or mass-export data from the Services.
- Interfere with the security features of the Services or attempt to bypass authentication via Authgear.
- Use the support forms or contact channels to submit excessive requests, spam, or content that is abusive, threatening, or unsolicited.
6. Payments and Refunds
A. Premium Features
Certain features may require a subscription or one-time payment.
B. Payment Processing
Payments are processed via the Apple App Store, Google Play Store, or Stripe. By making a purchase, you also agree to the respective payment processor's terms.
C. Refunds
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:
- to cancel your service contract with us; and
- to a refund for the unused portion, or to compensation for its reduced value.
Change of Mind: Except as required by the Australian Consumer Law or other applicable laws, all payments (including subscriptions and one-time purchases) are non-refundable. We do not provide refunds or credits for "change of mind" or for partially used subscription periods.
- Apple App Store: Refunds are subject to Apple’s standard refund policy.
- Google Play Store: Refunds are subject to Google Play’s standard refund policy.
- Stripe: Refunds are handled at our discretion in accordance with the Australian Consumer Law.
7. Termination
We reserve the right to suspend or terminate your access to the Services or your Kontour Identity account immediately, without prior notice or liability, if you breach these Terms or engage in conduct that we determine to be inappropriate or harmful to the Services or other users.
8. Limitation of Liability
To the maximum extent permitted by the Competition and Consumer Act 2010 (Cth):
- Kontour Labs excludes all implied guarantees, conditions, and warranties.
- Our total liability for any claim arising out of these Terms shall not exceed the amount you paid to us (if any) in the 12 months preceding the claim.
9. Changes to These Terms
We may update these Terms from time to time. We will notify you of any material changes via an in-app notification (such as a pop-up), email, or a prominent notice on our website. You may be required to actively accept the updated Terms to continue accessing the Services. Your continued use of the Services after the effective date of the changes constitutes your acceptance of the new Terms.
10. Governing Law
These Terms are governed by the laws of Western Australia. You agree to submit to the exclusive jurisdiction of the courts of Western Australia.
